Terms of Use

These Terms of Use ("Terms") govern your access to and use of the eSpaVN website and related services (collectively, the "Service"). The Service helps users discover spas and massage providers and request bookings or contact a spa.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Acceptance of Terms

You must comply with these Terms and all applicable laws when using the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it.

2) Eligibility

You must be able to form a legally binding contract under applicable law. If you are under the age of majority, you may use the Service only with consent of a parent or legal guardian.

3) The Service

3.1 Spa Directory

The Service may display information about spas and massage providers ("Merchants"), including names, addresses, amenities, service descriptions, and contact details ("Listing Content"). Listing Content may change over time and may not always be complete or current.

3.2 Booking Requests and Communications

The Service may allow you to submit booking requests or messages to Merchants. A booking request is not a guarantee of availability, acceptance, or service delivery. The Merchant is responsible for confirming, rescheduling, or declining requests.

4) Payments

The Service does not guarantee online payment processing. Any payments for massage or spa services are handled directly between you and the Merchant and are subject to the Merchant’s policies and applicable law.

5) Merchant Responsibility (Services, Pricing, Availability)

Merchants are responsible for:

  • Service delivery, hygiene and safety practices
  • Accurate descriptions of massage/spa services and duration
  • Pricing, taxes, fees, and receipts (if applicable)
  • Availability, scheduling, and any changes or cancellations

You acknowledge that Listing Content may sometimes be outdated or incorrect, and that services, pricing, and availability can change.

6) Accounts (If Applicable)

Some features may require an account. You agree to provide accurate information and keep it current. You are responsible for safeguarding your credentials and for activity that occurs under your account.

7) User Content

If you submit content to the Service (for example, feedback or messages) ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely for operating and improving the Service.

You represent that you have the rights to submit User Content and that it does not violate laws or third-party rights.

8) Prohibited Conduct

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Harass, threaten, defame, or violate the rights of others
  • Attempt unauthorized access to accounts, systems, or data
  • Disrupt the Service (malware, scraping at scale, denial-of-service, etc.)
  • Impersonate another person or entity

9) Intellectual Property

The Service (including its software, design, and branding) is owned by us or our licensors and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless permitted by us in writing.

Merchant names, logos, trademarks, and images remain the property of their respective owners.

10) Third-Party Services and Links

The Service may contain links to third-party websites or tools (for example, maps). We do not control and are not responsible for third-party content or practices. Your use of third-party services is subject to their terms.

11) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Listing Content is accurate, that the Service will be uninterrupted or error-free, or that any Merchant will accept or deliver services as requested.

12) Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Service or your interactions with Merchants.

13) Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your interaction with Merchants (to the extent caused by you).

14) Termination

We may suspend or terminate your access to the Service if we believe you violated these Terms or if required for legal or security reasons.

15) Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16) Governing Law and Jurisdiction

These Terms are governed by applicable law. Courts with jurisdiction where required by law will resolve disputes arising out of or relating to these Terms or the Service.
